What You Must Know
The consequences of being arrested for DUI can be severe, but finding out what you need to know and taking appropriate action can avert disaster. The better you are informed, the more power you will have to handle the situation as well as possible.
Speak to your attorney first. It is your legal right to communicate with an attorney when arrested, and by speaking to your legal representative as early as possible, you will stand a better chance of a fortunate outcome.
If you have taken a breathalyzer test, you are legally entitled to request a DMV hearing for a period of seven days. When you had finished the breathalyzer, you should have been issued a temporary license. This license only holds for seven days, for the duration of the period in which you can request a hearing. Simply by requesting the hearing, you will be able to continue driving until your hearing has been completed and a judgment has been reached concerning your driving privileges and the extent of their suspension.
If a blood test was administered, it will take about a month or slightly longer for your results to return. After the results have been finalized, you will receive a letter telling you that your license is suspended. Upon receiving this letter, you should contact us without delay.
Possible Penalties
There are a number of penalties you could face, even on your first offence, depending on how your hearing goes and factors such as blood or breathalyzer test results. Possible penalties in the State of Nevada include:
A short-term jail sentence of up to half a year
Fines up to $1000
Enforced alcohol or drug testing if you are above 18 years of age
8 hours of DUI education (which can be completed via the internet)
Your license being revoked for 90 days
With so many consequences possible, it is wise to obtain legal guidance and representation, for a better chance of a lenient outcome.
